Program Rules

Membership and participation in The Pacific Companies (TPC) Resident Rewards program is an exclusive privilege of living at a TPC property. All of the Program Rules and General Conditions below are applicable to every participant.

PROGRAM ELIGIBILITY

Eligibility for the program is based on the rewards program designed and approved by TPC. TPC has the right to modify or terminate this program at any time or to change the terms and conditions, rules, regulations, policies and procedures, benefits, conditions of participation, in whole or in part, at any time, with or without notice, even though changes may affect points or awards. Only one resident per unit is eligible to participate in the TPC Resident Rewards program. They must be 18 years of age or older.

TPC may, among other things, withdraw, limit, modify, or cancel any award; increase or decrease applicable points required for any award. Participants, in accumulating points, may not rely upon the continued availability of an award, and participants may not be able to obtain all offered awards.

Participation in the rewards program is subject to any Program Rules that TPC may, at its discretion, adopt or change from time to time. The terms of the Program Rules control your membership and participation in the program and no covenants at law or in equity shall be implied or incorporated. TPC has the sole right to interpret and apply the Program Rules. Any failure to follow Program Rules, any abuse of program privileges, any violation of law, rule or regulation, any conduct detrimental to the interests of TPC, any fraudulent activity or attempted fraudulent activity, or any misrepresentation of any information furnished to TPC or its affiliates by any participant, or anyone else acting on the participant’s behalf, may result in the termination by TPC of such member’s membership, the loss or cancellation of accrued points, awards or benefits, or both, or the loss of other program benefits. Terminated participants shall not be eligible to participate in any aspect of the program, and members whose accounts have been terminated shall not be eligible to enroll in the program again.

PROGRAM DATES

TPC Resident Rewards will begin for an eligible resident upon execution of a lease agreement, physical move in date, and completion of account activation process. TPC reserves the right to terminate this program at any time. Award points may be redeemed up to 90 days after the termination of the program.

RECEIVING POINTS

Reward participants will receive paperless, electronic rewards in the form of points. Point statements may be viewed online at the program web site using your personal email address and password.

BONUS POINTS

Bonus Points may be offered from time to time as TPC deems appropriate.

POINT LIFE

All points issued to a program participant will be valid for the life of the program. Once the program is discontinued, the participant will have up to 90 days to redeem points for rewards, unless the program is terminated for other reasons. Upon final termination, any and all unredeemed points (and the value thereof) shall be forfeited and no reward claims shall be honored thereafter. If a resident moves out of a TPC unit they must redeem their points prior to, or on their move out date. After that date, all points are forfeited. If a participant is evicted from a TPC property, their participation is terminated on the date they are served with their eviction notice, and all points will be forfeited.

NON PAYMENT OF RENT OR INAPPROPRIATE BEHAVIOR

In the event a program participant does not pay rent on time or in full, or demonstrates and displays behavior and/or conduct that TPC deems inappropriate, TPC has the right to ‘freeze’ the program participant from the TPC Resident Rewards program until such time as rent is brought current, and/or behavior and/or conduct is remedied.

NON RENEWAL, EVICTION, OR ABANDONMENT OF LEASE

In the event a program participant does not renew, is evicted, or abandons their lease with TPC, the participant shall forfeit any and all unredeemed points, and no reward claims shall be honored thereafter. Points are forfeited on the following day after a participant vacates their unit. If a tenant is evicted from their unit, points are forfeited on the same date the eviction notice is served.

NON-TRANSFERABLE / NO CASH VALUE

Points are non-transferable and are not redeemable for cash. The sale or barter or attempted sale or barter of any such points, awards, or benefits other than as authorized and/or sponsored by TPC, is expressly prohibited. Any points, awards, or benefits transferred, assigned or sold in violation of the Program Rules, in addition to exposing the participant to the penalties otherwise associated with violations, may be confiscated or canceled. The use of points that have been acquired by purchase, barter, or other conduct in violation of Program Rules may result in termination of participant in the rewards program, cancellation of accrued points, awards or benefits, and/or confiscation of the awards.

AVAILABILITY

All rewards of merchandise, ticketed events, airline and hotel accommodations, and any other travel included in the rewards program are available only to program participants who have received points as part of this loyalty, points-based program. Reward items offered are subject to availability and may be changed at any time.

The on-site property manager and property management company are not affiliated with the program and cannot answer questions or make changes to your points or rewards.

GENERAL CONDITIONS

  1. Use of the program website is governed by separate and specific Terms and Conditions, which are located on the TPC Resident Rewards website.

  2. TPC reserves the right to audit, alter, or cancel this program at any time in its sole discretion, including, and without limitation, the program format, program partners, program elements, reward levels and reward rules. All such changes may be made without prior notification to program participants. In all matters relating to the interpretation and application of the Program Rules, the decisions of TPC will be final.

  3. TPC, its owners, agents, and employees make no guarantees, warranties, or representations of any kind, expressed or implied, with respect to items of merchandise or travel, and shall not be liable to program participants or any third party for any damage, loss, expense (including, without limitations, attorney fees), or harm of any nature which arises in whole or in part from the underlying travel or merchandise services, arranged for the program participant in connection with the program.

  4. TPC shall not be liable in the event that performance is made impossible, or by acts of God, civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, theft, malicious damage, fire, explosions, earthquakes, floods, the elements, lightning, wind, or fire resulting from any of the foregoing, strikes, labor disputes, or any other causes beyond the reasonable control of TPC.

  5. In the event any dispute arises between TPC and a program participant regarding the Program Rules or any other dispute which is in any way related to the program, the parties agree that the sole and exclusive forum for the resolution of such disputes will be arbitration to be held before the American Arbitration Association or any successor entity pursuant to the commercial rules of arbitration then pertaining.

  6. If any provision of the Program Rules shall be declared to be invalid, unenforceable, or void, such decision shall not have the effect of invalidating or voiding the remainder of the Program Rules. Upon such event, the parties shall, in good faith, modify or alter the remainder of the Program Rules to effectuate the original intent of the parties.

  7. TPC reserves the right to audit any and all accounts at any time to ensure compliance with the Program Rules, without notice to the participant. During the course of an audit or investigation, a participant’s account information may be shared with any third party with whom TPC has contracted to assist in performing such audit or investigation. In the event that an audit reveals discrepancies or possible violations, TPC may delay the processing of award, redemption requests, cancel any outstanding award redemptions, withhold statements or suspend the rewards account of a participant pending completion of the audit. While the account is suspended, the participant may continue to accrue points in the account, but no reward redemptions or other transactions will be permitted, and any outstanding award redemptions will be cancelled. Cancelled award redemptions must be surrendered to TPC upon TPC’s request. Upon completion of the audit, if a discrepancy or violation has been determined by TPC, in addition to any other remedies described herein, points may be removed from the account of the participant to remedy such discrepancy or violation with or without notice to the participant.

  8. Each participant shall be responsible for remaining knowledgeable as to the Program Rules and the amount of points in such participant’s account. TPC shall attempt to advise active participants of various matters of interest through such means as may be appropriate, such as account summaries, emails, and its website, but TPC shall have no liability for any failure to do so. TPC will not be responsible for correspondence lost or delayed in the mail.

  9. Accrued points do not constitute property of the participant and are not redeemable for cash. However, if a program participant wishes to gift points to another participant, as found in the ‘Unique’ category of the Redeem Rewards section, the participant may contact us via the Contact Us form on this website to transfer points to another active program participant.

  10. In accordance with U.S. tax law, TPC may be required to send to you and file with the IRS a Form 1099-MISC (Miscellaneous Income) for the year in which a reward is issued to you. The valuation of Resident Reward point redemptions for Form 1099-MISC tax reporting purposes will be at TPC’s sole discretion. You are solely responsible for any personal tax liability arising out of the redemption of Resident Reward points.

  11. TPC has the sole discretion to interpret and apply the Program Rules and General Conditions, and all questions or disputes regarding these will be resolved by TPC in its sole discretion.

  12. Nothing in these Program Rules or General Conditions will limit TPC from exercising any legal rights or remedies that it may have.
